Sweepstakes Dates: The 2009 Exmark Gear Giveaway Sweepstakes (“Sweepstakes”) begins at 12:00 a.m. Eastern Time (“ET”) on 1/7/09 and ends at 11:59 p.m. ET on 10/31/09 (the “Promotion Period”).

Who is Eligible: To enter, you must be a legal resident of the 50 United States or Washington D.C. and be age 18 or older. Employees, officers, directors and agents of Exmark ("Sponsor"), American Hole 'n One ("Administrator"), Kawasaki, Adventure Advertising, Remington, Realtree, Bushnell, Costa Del Mar, and each of their respective parents, affiliated companies, subsidiaries, distributors, dealers, retailers, printers, advertising and promotion agencies and any and all other companies associated with the design or execution of this Sweepstakes (collectively, the “Promotion Parties”), and the members of the immediate families (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) or households, whether or not related, of any of the above, are not eligible to enter or win. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void where prohibited by law.

How to Enter – During the Promotion Period, there are two (2) ways: 1. Visit the Exmark display at participating Exmark Outdoor Tour stops during the Promotion Period, complete an official entry form, while supplies last, and deposit the entry form in the designated entry box by the specified deadline. For a list of participating events, visit www.exmarkoutdoors.com. No one may enter another individual’s name into the Sweepstakes. Only official entry forms may be used; photocopied or facsimile entries will be void. All entries must be hand-printed. Limit one (1) on-site entry per person, per household and per event date for the entire Promotion Period. On-site entries received from any person or household in excess of the stated event date limitation will be void. 2. Register online at www.exmarkoutdoors.com by completing the online entry form with all required information and submitting as instructed therein. All entries must be submitted by 11:59 p.m. ET on 10/31/09 to be eligible. Entries generated by script, macro or other automated means will be void. Limit one (1) online entry per person, per household and per e-mail address for the entire Promotion Period. Online entries received from any person, household or email address in excess of the stated limitation will be void. Entries by any means which subvert the entry process will be void. Entrants must complete all required information on the entry form to be eligible. All entries become the property of the Sponsor and will not be returned.

CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, ADMINISTRATOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Promotion Parties are not responsible for: (i) electronic transmissions or entries that are lost, late, stolen, incomplete, inaccurate, damaged, garbled, destroyed, illegible, misdirected, undelivered, delayed or not received by the Promotion Parties or their respective agents for any reason, or for any entries submitted in a manner that is not expressly allowed under these Official Rules and all such entries will be void; (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries, or for destruction of or unauthorized access to, or alteration of, entries, including lost or stolen entry boxes, (iii) failed or unavailable hardware, network, software or telephone transmissions, damage to entrants’ or any person’s computer and/or its contents, or causes that jeopardize the administration, security, fairness, integrity or proper conduct of this Promotion, or (iv) any other errors or problems relating to or in connection with this Sweepstakes, whether computer, network, technical, mechanical, printing, typographical, human or otherwise, including, without limitation, errors or problems which may occur in connection with the administration of the Sweepstakes, the processing of entries, the conducting of the Sweepstakes, the announcement of the prizes, the cancellation of any event or in any Sweepstakes-related materials. All incomplete or non-conforming entries will be void. Administrator reserves the right to cancel, modify or terminate the Sweepstakes if fraud, misconduct or technical failures, including non-authorized human intervention or other causes, destroy or threaten the integrity of any portion of the Sweepstakes, in the opinion of the Administrator, or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper conduct of the Sweepstakes as determined by Administrator, in its sole discretion. In the event of early termination of any portion of the Sweepstakes, Sponsor reserves the right to conduct a drawing from among all eligible, non-suspect entries received up to time of such impairment. In the event of a dispute as to online entries submitted by multiple users having the same e-mail account, entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry, provided such person meets the eligibility requirements of these Official Rules. "Authorized account holder" means the natural person who was assigned an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide proof (to Promotion Parties’ satisfaction) that he/she is the authorized account holder. Any damage made to the web site will also be the responsibility of the authorized e-mail account holder
